Between You ("User") and Butti (the "App", "We", "Us", "Our")
Welcome to Butti, an AI-powered image generation mobile application ("App") that enables Users to create visual artwork from natural language prompts. By downloading, accessing, or using Butti (including its features, content, and services), you ("User", "You") agree to be bound by this User Agreement (the "Agreement"), as well as our Privacy Policy (available separately) and any additional terms incorporated by reference. If you do not agree to all terms of this Agreement, you must not use the App.
Butti is provided "as-is" and does not require account registration or login to access basic functionality. However, certain premium features may require a credit-based system (as outlined in Section 4) to ensure fair usage.
To use Butti, you must be at least 13 years old (or the minimum age required by applicable law in your jurisdiction, such as 16 years old under the European Union's General Data Protection Regulation). If you are between 13 and 18 years old (or the applicable age of majority), you must have the consent of a parent or legal guardian to use the App, and such parent or guardian must agree to this Agreement on your behalf.
By using Butti, you represent and warrant that: (a) you meet the eligibility requirements above; (b) you will use the App in compliance with this Agreement and all applicable laws (including, without limitation, Canadian federal, provincial, and territorial laws, such as the Canadian Consumer Protection Act, Copyright Act, and Personal Information Protection and Electronic Documents Act (PIPEDA)); and (c) you will not use the App for any unlawful, harmful, or fraudulent purpose.
You are solely responsible for:
Butti allows Users to: (a) submit natural language prompts to generate high-quality images using advanced AI technology; (b) customize generated images by selecting artistic styles (e.g., impressionism, retro comic, neon) and aspect ratios (e.g., square, landscape, portrait); and (c) access premium AI generation capabilities via a credit-based system (see Section 4).
We reserve the right to modify, suspend, or discontinue any feature of Butti at any time, with or without notice, for operational, legal, or business reasons. We will use reasonable efforts to notify Users of significant feature changes that may impact their use of the App.
You may not use Butti for any of the following purposes (collectively, "Prohibited Uses"):
We may, in our sole discretion, suspend or terminate your access to Butti if we determine that you have engaged in any Prohibited Use. We may also remove any generated content that violates this Agreement or applicable law.
Butti uses a credit-based system to regulate access to premium AI generation capabilities (e.g., high-resolution images, exclusive artistic styles). Upon first downloading the App, Users may receive a limited number of free credits for trial purposes ("Free Credits"). Free Credits are non-transferable, non-refundable, and expire after [30] days from the date of issuance, unless otherwise stated.
Users may purchase additional credits ("Paid Credits") through the App's in-app purchase system. Paid Credits are subject to the pricing and terms displayed at the time of purchase. All payments for Paid Credits are final and non-refundable, except as required by applicable law (e.g., Canadian consumer protection laws that mandate refunds for defective goods or services).
Each use of a premium feature consumes a specified number of credits (as indicated in the App). We reserve the right to adjust credit consumption rates for premium features at any time, with notice to Users via in-app notification.
Credits (whether Free or Paid) are: (a) for personal, non-commercial use only (unless you have a commercial license from us); (b) non-transferable between Users; (c) not redeemable for cash or other monetary value; and (d) subject to expiration if not used within [12] months of purchase (for Paid Credits) or issuance (for Free Credits).
Butti (including its AI technology, software, code, user interface, logos, trademarks, and pre-existing content) is owned by us or our licensors and is protected by Canadian and international intellectual property laws (e.g., copyright, trademark, patent laws). You may not copy, modify, distribute, sell, or lease any part of Butti without our prior written consent.
For images you generate using Butti ("User-Generated Images"):
You represent and warrant that you have the right to submit all prompts used to generate User-Generated Images, and that User-Generated Images do not infringe on any third-party intellectual property or privacy rights. You agree to indemnify us against any claims, damages, or losses arising from a breach of this warranty.
BUTTI IS PROVIDED "AS-IS" AND "AS-AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO: (a) IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT; (b) WARRANTIES THAT BUTTI WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; (c) WARRANTIES THAT GENERATED IMAGES WILL MEET YOUR EXPECTATIONS OR BE SUITABLE FOR YOUR INTENDED USE; AND (d) WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR LEGALITY OF ANY CONTENT GENERATED OR SHARED VIA THE APP.
We do not guarantee that Butti will be compatible with all mobile devices or operating systems, or that it will operate without interruption in areas with poor internet connectivity.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW (INCLUDING CANADIAN LAW), WE SHALL NOT BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, OR GOODWILL) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF BUTTI, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY DIRECT DAMAGES ARISING OUT OF THIS AGREEMENT OR YOUR USE OF BUTTI SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US FOR PAID CREDITS IN THE [12] MONTHS PRIOR TO THE CLAIM.
This limitation of liability does not apply to: (a) damages arising from our gross negligence or willful misconduct; (b) damages arising from bodily injury or death; (c) damages required to be paid under applicable consumer protection laws; or (d) any other liability that cannot be excluded or limited by law.
You may terminate this Agreement at any time by uninstalling Butti from your mobile device and discontinuing all use of the App. Upon termination, any unused Free Credits will expire immediately, and unused Paid Credits will be refunded only as required by applicable law.
We may terminate this Agreement and suspend or terminate your access to Butti at any time, with or without notice, if: (a) you violate any term of this Agreement (including engaging in Prohibited Uses); (b) you engage in fraudulent or unlawful activity in connection with the App; (c) we are required to do so by law; or (d) we discontinue Butti or a significant portion of its features.
Upon termination by us for your breach of this Agreement, you will forfeit all unused Credits (Free or Paid), and we may pursue additional legal remedies if your actions caused us harm.
We may modify this Agreement at any time by posting the updated version in the App (under "Settings > Legal > User Agreement") and notifying you via in-app notification or email (if you provide contact information). The modified Agreement will take effect [14] days after the date of notification, unless you accept it earlier. If you continue to use Butti after the effective date of the modified Agreement, you agree to be bound by the updated terms. If you do not agree to the modified Agreement, you must stop using Butti and uninstall the App.
This Agreement is governed by the laws of the Province of Ontario, Canada, without regard to its conflict of laws principles. You agree that any dispute, claim, or controversy arising out of or in connection with this Agreement or your use of Butti (collectively, "Disputes") will be resolved as follows:
Any notices required or permitted under this Agreement will be in writing and will be deemed to have been given when delivered personally, sent by reputable overnight courier, or by email to the addresses provided by the parties. This Agreement constitutes the entire agreement between you and us regarding your use of Butti and supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The failure of either party to enforce any right or provision of this Agreement will not constitute a waiver of such right or provision. This Agreement is personal to you and may not be assigned or transferred by you without our prior written consent.
